ARTICLE 1 IDENTITY OF RUPERT COFFEE

5. Remote communication technology: any means that can be used for the conclusion of the agreement between these parties without the simultaneous physical presence of Rupert Coffee and the buyer.

ARTICLE 3 APPLICABILITY

8. Rupert Coffee reserves the right to change and/or supplement the General Terms and Conditions at any time for future orders.

9. By using the Rupert Coffee websites and/or placing an order, the buyer accepts these General Terms and Conditions as well as all other rights and obligations as stated on the website.

10. If one or more provisions of these General Terms and Conditions are at any time wholly or partially unlawful, void or for any other reason unenforceable, then this provision will be deemed severable from these General Terms and Conditions and not the affect the validity and enforceability of the remaining provisions. These General Terms and Conditions constitute the entire agreement between the buyer and Rupert Coffee with respect to the subject matter contained herein.

ARTICLE 4 OFFERS AND CONCLUSION OF AGREEMENTS

1. Offers are valid as long as they are stated on the website and while supplies last.

2. If the offer is subject to certain conditions, this will be expressly stated in the offer.

3. Rupert Coffee always describes as completely and accurately as possible what they sell and how the ordering process will proceed. 6. The consumer who purchases coffee products from Rupert Coffee is the end consumer. The coffee products may not be resold in any way.

ARTICLE 5 ORDERS

1. To purchase a coffee product online, the coffee product must be added to the shopping cart, after which the buyer's contact and billing details must be entered. After this, the buyer can choose the method of delivery. After this moment it is no longer possible to change the billing details.

ARTICLE 6 PRIZES

1. All prices are expressed in euros and include VAT or any other tax imposed by the authorities.

2. We use cookies to provide you with the best possible service on our website. If you continue to use our website, you agree to our use of cookies. We keep certain choices of our visitors for subsequent visits to this website (such as language and country choice).

3. The price will be invoiced in the currency in which the buyer placed his order.

4. The buyer owes the price that was agreed upon during the last step of the ordering process and which Rupert Coffee communicated in its order confirmation. Obvious errors in the quotation, such as obvious inaccuracies, can also be corrected by Rupert Coffee after the conclusion of the agreement.

5. Delivery costs are clearly communicated to the buyer. Certain payment methods are subject to further conditions regarding the delivery method and any costs. This will be clearly communicated to the buyer.

ARTICLE 7 PAYMENT

1. Payment for orders via the website can be made in the following ways: VISA, BANKCONTACT, MASTERCARD, RUPERT COFFEE GIFT CARD

2. Rupert Coffee may expand payment options in the future. Expansion of the payment options will also be announced via the website.

3. If a credit card payment method is chosen, the terms and conditions of the relevant card issuer apply. Rupert Coffee is not a party to the relationship between the buyer and the card issuer.

ARTICLE 8 DELIVERY AND DELIVERY PERIOD

1. All coffee products are delivered to the address specified by the buyer when placing the order.

2. Orders are processed and delivered as quickly as possible. Rupert Coffee strives to deliver the order within the time stated in the individual order confirmation. Any delay will under no circumstances give rise to compensation. Incorrectly provided delivery addresses are the responsibility of the buyer and may result in additional costs that will be recovered from the buyer.

3. Products are only delivered to the countries for which the website allows delivery.

4. We do not serve overseas territories for France. For Spain we do not serve islands such as the Balearic Islands or the Canary Islands.

5. Delivery within EU only.

6. If a specified indicative delivery time is not met, Rupert Coffee will not notify the buyer of this. The buyer can always contact Rupert Coffee via the contact form to know a probable delivery date.

7. Shipments are always made at the risk of Rupert Coffee . The buyer therefore does not have to worry about coffee products being lost in the mail. However, if coffee products are returned, the buyer is responsible for transportation.

8. As soon as the coffee products to be delivered have been delivered to the specified delivery address, the risk as regards these products passes to the buyer.

9. From the moment of receipt by the buyer, the buyer must store the coffee at a temperature between 15°C and 18°C ​​and protected from direct sunlight and moisture. Rupert Coffee does not recommend storing coffee in the refrigerator or freezing it.

10. The buyer or any other person must be present at the specified address at the time of delivery of the coffee product to receive it.

11. Rupert Coffee is not liable for failed deliveries if: I. the buyer provides an incorrect or outdated address; II. no one is present at the address specified by the buyer.

12. Rupert Coffee 's total liability for failure to meet its obligations will in no event exceed the purchase price of the coffee product(s) in question.

13. Given the nature of the coffee product, PO box addresses are not accepted.

ARTICLE 9 RIGHT OF WITHDRAWAL

1. According to Book VI of the Economic Law Code, there is no right of withdrawal for foodstuffs, perishable goods and coffee products manufactured according to the buyer's specifications. Every purchase is therefore final and will not be taken back by Rupert Coffee .

ARTICLE 10 RESERVATION OF TITLE

1. Notwithstanding actual delivery, ownership of a coffee product will only be transferred to the buyer after the buyer has fully paid the payment due for this coffee product, including reimbursement of interest and costs.

2. The buyer may not tax, sell, resell, alienate or otherwise encumber the products before ownership has been transferred.

ARTICLE 11 LIMITATION OF LIABILITY

1. The website is offered to you without explicit or implicit guarantees regarding its correct functioning. Rupert Coffee is not liable for damage resulting from the use of the website, regardless of whether it turned out to be correct or incorrect, nor for damage caused by incorrect, incomplete, ambiguous or outdated content or language errors on the website.

2. In any case , Rupert Coffee 's liability for any damage will always be limited to the amount of the last order.

3. Rupert Coffee makes every effort to provide access to the website 24 hours a day, 7 days a week. 2. The products sold by Rupert Coffee are fresh foods. Rupert Coffee does its utmost to ensure correct and safe delivery, taking into account the freshness of its coffee products, but cannot give an absolute guarantee about the quality of transport. The consumer is also obliged to immediately place the received coffee products in a cool room in order to guarantee the quality of the coffee products.

3. In the exceptional case that the quality of the delivery is nevertheless affected, the Buyer must immediately provide proof of this at the time of delivery. The buyer is always obliged to carefully inspect the coffee products immediately upon receipt. Complaints from the buyer that relate to defects in the coffee product or the delivery that are externally noticeable (for example if the products are no longer fresh or were damaged during transport) must therefore be immediately notified by the buyer to Rupert Coffee . will be notified by e-mail on the same day of delivery.

4. Defects caused by the consumer not placing the product in a cool room on time cannot be recovered from Rupert Coffee .

ARTICLE 13 FORCE MAJEURE

1. In the event of force majeure , Rupert Coffee is not obliged to fulfill its obligations. In that case, it can either suspend its obligations for the duration of the force majeure or definitively terminate the agreement.

2. Force majeure is any circumstance beyond the will and control of Rupert Coffee that prevents the fulfillment of its obligations in whole or in part. This includes, but is not limited to: strikes, unexpected traffic jams, accidents on European roads, fire, business disruptions, energy disruptions, disruptions in a (telecommunications) network or connection or communication systems used and/or unavailability at any time. of the website, non-delivery or late delivery from suppliers or other engaged third parties, etc.

ARTICLE 14 INTELLECTUAL PROPERTY

ARTICLE 15 COMPLAINTS PROCEDURE

1. Rupert Coffee does everything possible to ensure 100% customer satisfaction. If the buyer has any complaints about its services and/or products, he or she can contact Rupert Coffee by email at rupert-coffee@hotmail.com . Rupert Coffee has a sufficiently publicized complaints procedure and handles the complaint in accordance with this complaints procedure.

2. Every complaint will be handled within 7 working days.

ARTICLE 16 APPLICABLE LAW AND COMPETENT COURT

1. All offers and agreements are exclusively governed by Belgian law.

2. All disputes relating to or arising from offers from Rupert Coffee or agreements concluded with it will be submitted to the competent courts and tribunals of Brussels, unless a mandatory legal provision expressly designates another court as competent.
